DEBT COLLECTOR HARASSMENT
Harassment by a debt collector can come in different forms but examples include repetitious phone calls intended to annoy or abuse, obscene language, and threats of violence.
No harassment: The Fair Debt Collection Practices Act (FDCPA) says debt collectors can't harass, oppress, or abuse you or anyone else they contact.
Some examples of harassment are:
* Repetitious phone calls that are intended to annoy, abuse, or harass you or any person answering the phone
* Obscene or profane language
* Threats of violence or harm
* Publishing lists of people who refuse to pay their debts (this does not include reporting information to a credit reporting company)
* Calling you without telling you who they are
Under the law, you can direct the debt collectors to stop contacting you and they must obey the direction.
CREDIT REPORT PROBLEMS
Credit reporting agencies such as TransUnion, Experian and Equifax often error. In fact, about 80% of credit reports contain errors. Many of these errors will cause in a lower credit score resulting in denial of credit, high down payment, higher interest rates, higher insurance premiums, lost employment opportunities and more.
COMMON CAUSES FOR CREDIT REPORT ERRORS
When a credit report contains errors, it is often because the report is incomplete, or contains information about someone else. This typically happens because:
The person applied for credit under different names (Robert Jones, Bob Jones, etc.). Someone made a clerical error in reading or entering name or address information from a hand-written application. The person gave an inaccurate Social Security number, or the number was misread by the lender.
Loan or credit card payments were inadvertently applied to the wrong account.
Identity Theft – for the past decade, this has been one of the fastest growing crimes in America. A person may steal your personal information or be sold your information and opens credit accounts in your name.
Payments reported as late when they are not – Some creditors have collection departments that report payments several days and sometimes weeks after receiving a payment from you. Derogatory information that remains on a credit report for longer than seven (7) years. Bankruptcy information that remains on a credit report for longer than ten (10) years. Homes being reported as foreclosures, when no foreclosure proceeding has ever been started by the lender.
